Internet Forum Implodes

A LeFlore County News Editorial

Persons interested in discussing the hottest issue in LeFlore County, Oklahoma have one less internet forum in which to do so today.

The administrator of the forum operated by Cyberlink Rural Telecommunications, Inc. of Poteau, OK went into an apparent meltdown over the weekend and dumped not only hundreds of discussions regarding Barbara Ellison's battle for justice but also deleted the section of the forum called 'Barbara's Place' where such discussions took place, going to the extreme of banning Barbara Ellison and the supporters of her battle for justice from accessing the forum.

While Cyberlink's owners have every right to operate their private business as they see fit, their actions in this instance do send a message. A message that the company's owners are not interested in hosting an open forum where a variety of views are expressed and discussed but rather one where discussions of the sad state of affairs in LeFlore County, Oklahoma are forbidden, as are those that seek to discuss them.

With the demise of the CLNK forum as an open and uncensored medium for discussion of LeFlore County issues there are but two such forums left in which Barbara Ellison's fight for justice may be openly discussed.

Those are 'The Oklahoma Forum' and 'At Home in the Choctaw Nation'. Both of which welcome all and do not engage in censorship, banning or have administrators that go into meltdowns at a moments notice or have a hidden agenda.

News From The Legal Front

The bond hearing previously scheduled for today for Barbara Ellison on the assault and battery charges has been canceled. The next court date in the case is January 26, 2006.

Two days ago, Ellison's neighbors filed a quiet title lawsuit in LeFlore County District Court. The quiet title suit names several defendants including Barbara Ellison and Oklahoma Western Telephone Company.

Evidently the plaintiffs named the telephone company as a defendant owing to the fact that the phone company's cable serving the area is located on the county right-of-way. Naming the phone company as a defendant may be an attempt to backdoor a claim to county land without naming the county commissioners as defendants.

A postint on an forum offered an interesting observation on this lawsuit:

It's going to be very interesting to see what happens when the defense starts handing out subpoenas to various and sundry government officials, including county commissioners, tax assessors, assistant districts attorney, sheriff's deputies and office employees, a couple of judges and one notary public. These in addition to various officials at the Oklahoma Banking Department and the Oklahoma Corporation Commission, as well as a couple of bankers, surveyors and maybe even one attorney that actually held a mortgage on what is now the Ellison property.

It's gonna' be very interesting indeed...

It certainly is going to be interesting and very informative when all those government officials and business people are dragged into court to testify under oath...

Justice Denied - Day 22

It has now been 22 days since Sara Crase allegedly shouted death threats to Barbara Ellison, in Summerfield, OK on October 24th.

It has now been 20 days since Barbara Ellison was forced to hand carry into the LeFlore County Sheriff's office her complaint and four witness statements pertaining to those alleged death threats.

Ms. Ellison had to go to the sheriff's office to make her report because that office failed to respond for her emergency call for assistance.

One can only ponder how long District Attorney Farley Ward intends for justice to be denied.

It was Farley Ward that within less than 24 hours of an allegation of assault and battery against Barbara Ellison sought a warrant for her arrest. It is obvious that DA Ward knows how to obtain a warrant in a timely manner. At least when he wishes to do so.

Why is it taking DA Ward so long to seek a warrant for the arrest of Sara Crase on far more serious allegations?

LeFlore County District Attorney Farley Ward should either uphold his oath of office and seek an arrest warrant for Sara Crase or acknowledge in public that certain persons, aka 'Friends of Farley', are immune from prosecution for their alleged crimes.

If Farley Ward is a 'fair man', as an anonymous comment to this blog indicated, he will seek an arrest warrant against Sara Crase. If he continues to refuse to do so, that refusal will tell us all the kind of man he really is.

Setting It Straight

In "DA Farley Ward's Double Standards", LeFlore County News questioned why District Attorney Farley charged Barbara Ellison with assault and battery for defending herself and her property and yet has thus far refused to charge Sara Crase with death threats against Barbara Ellison.

An anonymous comment in reply to that article stated:

The reason is there are no terroristic threatening laws in Oklahoma. But there are laws against Assault and Battery.

As far as it goes that statement is true. There is no 'terroristic threatening law' per-se in Oklahoma.

There are however laws against making threats, including threats of serious injury or death.

For example in the Oklahoma Statutes Title 21, Chapter 55, Section 1362 it states:

If any person shall willfully or maliciously disturb, either by day or night, the peace and quiet of any city of the first class, town, village, neighborhood, family or person by loud or unusual noise, or by abusive, violent, obscene or profane language, whether addressed to the party so disturbed or some other person, or by threatening to kill, do bodily harm or injury, destroy property, fight, or by quarreling or challenging to fight, or fighting, or shooting off any firearms, or brandishing the same, or by running any horse at unusual speed along any street, alley, highway or public road, he shall be deemed guilty of a misdemeanor, and, on conviction thereof, shall be fined in any sum not to exceed One Hundred Dollars ($100.00), or by imprisonment in the county jail not to exceed thirty (30) days, or by both such fine and imprisonment, at the discretion of the court or jury trying the same.

Also in the Oklahoma Statutes Title 21, Chapter 55, Section 1362 it states:

If any person shall make use of any profane, violent, abusive or insulting language toward or about another person, in the presence or hearing, which language, in its common acceptation, is calculated to arouse to anger the person about or to whom it is spoken or addressed, or to cause a breach of the peace or an assault, every such person shall be deemed guilty of a breach of the peace, and, upon conviction thereof, shall be punished by a fine in any sum not to exceed One Hundred Dollars ($100.00), or by imprisonment in the county jail not to exceed thirty (30) days, or by both such fine and imprisonment, at the discretion of the court or jury trying the same.

Either of these two Oklahoma laws qualify as the basis for charges against Sara Crase for the alleged threats against Barbara Ellison on October 24, 2005.

Of the two laws referenced above, the first appears the most applicable as it contains the phrase or by threatening to kill, do bodily harm or injury and the allegations by Barbara Ellison and witness statements specifically mention such threats.

The second law referenced above also could be applied as what would be threats of grave bodily injury or death if not violent, abusive?

Yes, it is true that Oklahoma does not have a 'terroristic threatening law' per-se. It is also true that threats of injury or death are illegal under both of the laws referenced above.

If a layman can find these laws in the on-line reference to the Oklahoma Statutes and you the reader can click on a link and view them for yourselves, why is it that District Attorney Farley Ward can not seem to accomplish this same task?

Is DA Farley Ward that incompetent?
Or is something more sinister going on here?

Could it be that Sara Crase has one of those 'Friends of Farley' - stay out of jail free cards?

Major House Cleaning Sweeps Internet Forums

LeFlore County News has learned of what is apparently a hurried yet massive effort to 'cleanse' hundreds if not thousands of posts concerning Barbara Ellison and the scandal that is The Fence of LeFlore County from various internet forums catering to LeFlore County residents.

The first such purge occurred on the Oklahoma Forums site, where multiple threads containing hundreds of posts filled with hate filled rhetoric and making fun of Barbara Ellison's recent arrest on what many feel are trumped-up charges were deleted. This apparent panic driven purge also removed clandestine pictures of Ellison being escorted into the courthouse and which only two weeks ago were a source of pride for the dozen or so of her rabid detractors.

This of course leaves one to question why posts the forum's users were so proud of just days before suddenly became such a cause for embarrassment for them that they had to be removed.

Within one day of the cleansing of Oklahoma Forums a similar incident took place on the CLNK forum hosted by the Poteau, Oklahoma ISP of the same name.

For the past few weeks the moderator of the CLNK forum had permitted only a single thread containing any mention of Barbara Ellison and her fight for justice in this morally bankrupt county.

At the time of the cleansing of the CLNK forum that single thread contained hundreds of posts with the vast majority of them in support of Barbara Ellison and from a public aroused over her mistreatment at the hands of not only her neighbors but government officials.

The now deleted thread also contained some hate filled rhetoric from Ellison detractors and a picture of her being escorted into the courthouse in October. Evidently the operator of the CLNK forum took a page from book of the operator of the Oklahoma Forums and decided to eliminate posts regarding Barbara Ellison and the scandal before they slipped out of the closed community of LeFlore County.

We have reason to believe that these efforts at containment are doomed to fail, as rumor has it that every post had previously been archived and will again see the bright light of day. The only question is when and where they will resurface and in what form.

LeFlore County residents seeking an on-line home do have alternatives.

Alternatives which do not censor posts, whose moderators do not panic and suddenly cleanse the forum of posts which might embarrass themselves or their cronies. Alternatives where all are welcome, differing views are encouraged and truth is allowed, no matter whose ox is gored in the process.

DA Farley Ward's Double Standards

On 10/24/05 Belinda Wolfe alleged in a complaint filed with the LeFlore County Sheriff's Office that Barbara Ellison had committed assault and battery upon her.

Also on 10/24/05 Barbara Ellison attempted to file a complaint with the LeFlore County Sheriff's Office in regard to alleged death threats made against her by Sara Crase, the daughter of Belinda Wolfe. The sheriff's office failed to respond.

On 10/25/2005 District Attorney Farley Ward's office obtained an arrest warrant for Barbara Ellison on a misdemeanor assault and battery count and Ms. Ellison was arrested when the Undersheriff and two deputies came to her home.

On 10/26/2005 Barbara Ellison walked into the LeFlore County Sheriff's Office and filed a complaint alleging death threats were made against her by Sara Crase on 10/24/05.

In the former instance the DA's office responded with an arrest warrant in about 24 hours. In the latter instance the DA's office has not responded at all.

Two women allege crimes committed against them and on the same day. One alleging misdemeanor assault and battery the other alleging threats of death. In the one case an arrest warrant is issued within 24 hours. In the second case no arrest warrant has been issued at all and it is now 11 days since the alleged offense and 9 days since the victim of that offense was forced to travel to the sheriff's office to lodge the complaint.

It appears that within LeFlore County certain persons are exempt from prosecution. It also appears that certain persons are unjustly targeted for prosecution.

On what basis one falls into the first or second category is not clear. It would be a lot simpler if District Attorney Farley Ward would issue little badges, medallions or even paper stickers which contain the letters "FoF" to denote Friends of Farley. At least that way law abiding persons would know not to bother complaining when crimes are committed against them by a FOF.

As District Attorney, Farley Ward is required by the US and Oklahoma Constitutions and state law to apply the law fairly and equally.

When do you reckon he is going to start?

Poteau Daily News - Why Now?

For two years Barbara Ellison of Summerfield, OK has been complaining of crimes committed against her by various parties involved in an illegal land grab in LeFlore County, Oklahoma. On numerous occasions she has filed reports and official complaints with law enforcement involving crimes committed against herself, her mother and her property. Each time LeFlore County law enforcement turned a blind eye to her plight and a deaf ear to her calls for help, including a recent emergency call for assistance following alleged death threats.

For six months a fence illegally constructed across both her property and a county right of way prevented her and her mother from driving off of or onto their property.

The Sheriff's Office refused to act against the illegal fence and those that constructed it. The County Commissioners refused to get involved although county land was being illegally fenced off. The District Attorney's office refused to act on Ms. Ellison's complaints, possibly because an assistant district attorney is related to one of the parties in the land grab.

When their lives were threatened, both Barbara Ellison and her mother filed for protective orders to no avail in part because an official report necessary for the protective order hearing mysteriously went missing from the LeFlore County Sheriff's office and just at the right time.

On numerous internet forums and web sites Barbara Ellison told her story to the world and civilized people everywhere were shocked by the terror, torment and criminality that the pair had endured for so many months while local law enforcement did nothing to stop it and in the opinion of some condoned and encouraged it.

And not once during this entire time frame did the largest circulation newspaper in LeFlore County, the Poteau Daily News, mention Ms. Ellison or her plight. That is UNTIL she was arrested on what some consider a trumped up charge of assault and battery for forcefully removing a trespasser from her property.

A week after Ms. Ellison's arrest and booking the Poteau Daily News ran a 'story' of Ellison's arrest mentioning in passing the fact that she had allegedly received death threats but that no report of such could be found.

Well, duh!

If the sheriff's office will not investigate complaints lodged by Ms. Ellison and her mother, odds are high there will be no official reports of such threats on file in the courthouse.

It is a reasonable question to ask the Poteau Daily News, 'Why now?'.

Why after months of ignoring Barbara Ellison and a situation that practically everyone with an internet connection in LeFlore County was well aware of did the Poteau Daily News suddenly decide to provide front page coverage of Barbara Ellison's arrest on a misdemeanor assault and battery charge?

Were there no child molestations, rapes, robberies, murders, drug busts or other typical LeFlore County news to occupy that front page space? Was it a slow news day?

Or was there something more sinister at work in your sudden interest in Barbara Ellison?

Double Standards At the Sheriff's Office

LeFlore County News has discovered that the LeFlore County Sheriff's Office failed to respond to an emergency call from Barbara Ellison regarding alleged death threats made against her by the daughter of the 'wolf woman'.

The death threats are alleged to have occurred on October 24th, shortly after Sheriff's Deputies left after conducting their investigation of the installation of a storage barn on Ellison's property and the ensuing altercation with the 'wolf woman'.

Radio logs from the LeFlore County Sheriff's office indicate that the call reporting the death threats and requesting assistance was received shortly after noon on 10/24/05. However there is no record of anyone from the LeFlore County Sheriff's office ever responding to the request for assistance. The Sheriff's office log does indicate that on 10/26/05, two days after the alleged death threats, Ellison hand carried into the Sheriff's Department a series of statements from herself, her mother and two other witnesses regarding the incident. This was of course one day after Ellison's arrest on an allegation of assault and battery of the 'wolf woman'.

There has been no explanation for why the Sheriff's Office responded within minutes to a call about a storage barn being installed and never responded at all to a call about death threats. To a reasonable person, death threats would seem to be far more deserving of attention than a complaint regarding the installation of a storage barn.

This grave disparity in handling of the two calls for assistance gives rise to questions regarding the priorities of the LeFlore County Sheriff's Office. One can only speculate upon how quickly the Sheriff's Office would have responded had the alleged death threats been made by Barbara Ellison rather than directed at her.

Residents of LeFlore County, Oklahoma might be well advised to check with the Sheriff's Office prior to installing storage barns on their property as it seems they now fall under the jurisdiction of the Sheriff's Office. Death threats on the other hand are apparently only addressed on a case-by-case basis and whenever the deputies get around to it. If ever.

Victim of Trespass Arrested

In one of the strangest quirks of law enforcement in LeFlore County history, Barbara Ellison, the victim of the trespass by the 'wolf woman', as reported previously by LeFlore County News, has been arrested.

LeFlore County Special Judge Jeff Mixon, who recently released a man accused of molesting an 18 month-old female family member on bond of $2,500, set bond for Ellison at $1,000. Ellison is charged with misdemeanor assault and battery for defending herself and her property against the 'wolf woman' on 10/24/05.

LeFlore County Undersheriff Bruce Curnutt, accompanied by Deputies Wesley Ritter and Roy Dugan swooped down upon Barbara Ellison at her home during the late afternoon of October 25th to make the arrest. Why the LeFlore County Sheriff's Office felt it necessary to send three men to arrest one woman is not apparent. Perhaps they were scared and felt over-whelming force was necessary, or maybe a couple of them were just along for 'laughs' at Ellison's expense or they wanted to visit with their friends next door.

This incident was the first time throughout the course of the scandal known as The Fence of LeFlore County that the LeFlore County Sheriff's Office has arrested anyone in-spite of numerous complaints by Barbara Ellison regarding crimes committed against her, her mother and their property.

As Ellison was being escorted into the LeFlore County courthouse by Deputy Roy Duggan, a series of photographs were taken of her and Deputy Duggan by what has been described as an 'old woman' accompanied by a young boy. Deputy Duggan who reportedly once told Barbara Ellison he "didn't want to see his name on the internet" may be dismayed to learn that the photographs were placed on various internet forums by unknown individuals apparently seeking to defame Ellison.

Owing to the quick response of family and friends in getting Ellison 'bailed out' she did not spend any time inside a jail cell.

The first hearing in this case is set for November 16th, before Judge Mixon who was previously disqualified from hearing a protective order case which Ellison brought against her neighbors. Ultimately the decision to disqualify Judge Mixon will rest with District Judge Williams, who previously disqualified him from the earlier case owing to his earlier personal involvement in the matter.

In light of the arrest of Barbara Ellison, some LeFlore County residents are asking, "Could it be that the LeFlore County justice system is sending a message?" One saying, "Don't complain about the crimes committed against you by our friends or you will be the one arrested?".

Workmen Verbally Assaulted by 'Wolf Woman' !

From various sources, LeFlore County News has learned that workmen installing a new storage barn on the property of Barbara Ellison in the community of Summerfield, in LeFlore County, Oklahoma were verbally assaulted by what is being described by some as 'a deranged wolf woman'.

Reports from the scene indicated that Ms. Ellison, the owner of the property where the storage barn was being installed, was forced to resort to physical force to remove the intruder from the property and in the process managed to grab a hand full of 'wolf hair'.

By the time LeFlore County Sheriff's deputies arrived on the scene the 'uprising' was over and the 'wolf woman' had retreated back to her den. Eyewitness reports indicated that the deputies interviewed all parties involved but we have no word on whether the intruder was taken to jail, taken to a mental facility or simply taken aback to cool off, soak her heels and comb her hair.

Ellison's property has been under seige for several months as revealed in The Fence of LeFlore County. However this is the first reported instance of an 'attack of a wolf woman' although we have had reports of a pack of male wolves trying to intimidate area residents.

We have searched the internet for more info on this bizarre incident and have managed to find a reference on the Neighbors From Hell site.
